These terms and conditions (the “Terms of Use") govern your access to and use of the Odyssey 3.14 mobile Application (the “App” or “App-book”) provided by Mobelite (“Mobelite", “we" or “us"). “Mobelite" includes, without limitation, www.mobelite.fr and all linked pages owned and operated by Mobelite (the “Website”), including http://www.odyssey314.com. By accessing or using the Odyssey 3.14 app-book, you are agreeing to be bound by these Terms of Use and are entering into a legally binding contract with Mobelite. Do not access or use the Mobelite if you are unwilling or unable to be bound by these Terms of Use.
You acknowledge and agree that we may modify these Terms of Use at any time, in our sole discretion. We will notify you of any changes by posting the revised version of our Terms of Use to this webpage, and the changes will be effective when posted. You should revisit these Terms of Service on a regular basis so that you are aware of any changes made to these Terms of Use since your last visit. You agree that your use of the App-book after the date on which any changes are posted on this webpage will constitute your acceptance of such modifications.
In order to synchronize your notes and bookmarks across multiple devices and submit contributions to this App-book, you may be required to establish an account (“Account"). Don’t reveal your Account information to anyone else. You are solely responsible for maintaining the confidentiality and security of your Account and for all activities that occur on or through your Account, and you agree to immediately notify Mobelite of any security breach of your Account. Mobelite will not be responsible for any losses arising out of the unauthorized use of your Account.
You agree to use the current App-book in compliance with all applicable usage terms
We hereby grant you a limited, personal, non-exclusive and non-transferable license to use and to display the text, images, videos, graphics, icons and data available on the App-book (the “Content") solely for your informational, non-commercial and personal use. This license is subject to your compliance with the terms and conditions of these Terms of Use and does not include or authorize: (a) any resale or commercial use of the Content; (b) the collection and use of any App-book listings, pictures, profiles, ratings or descriptions; (c) the distribution, public performance or public display of any Content, (d) modifying or otherwise making any derivative uses of the Content, or any portion thereof; (e) the use of any data mining, robots or similar data gathering or extraction methods; (f) downloading (other than the page caching) of any portion of the App-book or any information contained therein, except as expressly permitted on the App-book; or (g) any use of the Content other than for its intended purpose. Any use of the Content other than as specifically authorized herein is strictly prohibited and will terminate the foregoing license. Such unauthorized use may also violate applicable laws including without limitation copyright and trademark laws and applicable communications regulations and statutes. This license is revocable at any time.
When using this App-book, you agree to abide by common standards of etiquette and act in accordance with the law. For example and without limitation, you agree:
1- Certain portions of the App-book may include security technology that limits your use of the App-book. You will not violate, circumvent, reverse-engineer, decompile, disassemble, or otherwise tamper with any of the security technology related to the App-book for any reason, or attempt to assist another person to do so.
2- You will not access the App-book other than through the compatible third party stores (including, the Apple iTunes App Store).
3- You will not encourage or enable any other individual or group to do any of the foregoing.
This list of prohibitions provides examples and is not complete or exclusive.
Except for the foregoing licenses, you have no other rights in the Content and you may not modify, edit, copy, reproduce, create derivative works of, reverse engineer, alter, enhance or in any way exploit the Content in any manner. All rights not granted in these Terms of Use are reserved.
At the request of our publisher partners or otherwise, we may impose restrictions on your use of an App-book, including by imposing conditions or limitations on, or preventing, your ability to print or cut and paste.
The Mobelite app-books allow you to create and synchronize content (including any annotations, bookmarks, notes or similar markings that you might make), and such functionality is provided as an accommodation to you. We make no guarantee as to the availability or accessibility of such content. Such content may be stored on servers that are located outside the country in which you live.
The Mobelite App-books may contain links to certain Internet websites (“third party websites") or other content (“third party content") developed, sponsored or maintained by third parties unaffiliated with us. Should you leave the Mobelite using such a link, the content on the third party website you are viewing is third party content and is not provided or controlled by us. In other instances, we may embed or otherwise incorporate third party content in portions of the App-book. When we do this, we will indicate to you that the information is coming from a third party and not from us. For example, we may post a Twitter® feed which shows what our customers are saying about us or which may provide links to third party websites. All of this information is third party content and is also not provided or controlled by us. We have not developed, checked for accuracy or otherwise reviewed the content of any third party content or privacy policy of any third party website that we may embed or link to. Additionally, third party content could be offensive, indecent or objectionable. By providing access to third party content or third party websites, we are not recommending, endorsing or sponsoring any aspect of those websites. We are merely doing this as a convenience to our users. As such, we make no promises to you regarding any third party websites or any third party content accessible on or from the Mobelite. Portions of the App-book may allow you and other users of the Mobelite to post content or submit material, including on the Website, within the App-book or via third party websites (including, Facebook® and Twitter®). You may not post any content or submit any material that is illegal, obscene, threatening, harassing, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable, nor may such content or material consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of “spam." You acknowledge that Mobelite reserves the right (but has no obligation) to remove or edit such content and that content or material that has been posted or submitted by others may be offensive, indecent or objectionable. Mobelite takes no responsibility and assumes no liability for any content posted by you or any third party. If you do post content or submit material, you grant Mobelite a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. You grant Mobelite and its sublicensees the right to use the name that you submit in connection with such content, if they choose. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate these Terms of Use and will not cause injury to any person or entity; and that you will indemnify Mobelite for all claims resulting from content you supply.
The Content is protected by applicable intellectual property and other laws, including patent and copyright laws. We, our publisher partners and our other licensors reserve all of our and their rights in the intellectual property rights included in the App-book, which have not been expressly granted to you. Further, you may not distribute, modify, transmit, lease, sublease, loan, sell, reuse, re-post, use or create derivative works based on any App-book content for public or commercial purposes. Mobelite and the Mobelite logo are trademarks of Mobelite and are the subject of trademark registrations and applications in France and other countries. Apple, iPad and iOS are registered trademarks of Apple Inc. All other brand and product names are or may be trademarks of their respective owners. You do not have any license or right, by implication, estoppel, or otherwise, to use any trademark, logo or service mark displayed on the website without our written permission.
If you want to send us your feedback we ask that you send it to support@mobelite.fr and provide us only with specific feedback on Mobelite’s existing products and services; however, do not include any ideas, suggestions or materials that our Idea Submission Policy will not permit us to accept or consider. Any feedback you provide to us shall be deemed non-confidential, and Mobelite shall be free to use such information on an unrestricted basis.
It’s Mobelite’s policy not to accept or consider unsolicited ideas, including ideas for new advertising campaigns, new promotions, new or improved products or technologies, product enhancements, source code, processes, materials, marketing plans or new product names. Please do not submit any unsolicited ideas, original creative artwork, suggestions or other works in any form (“submissions”) to us or to any of our employees. The purpose of this policy is to avoid potential misunderstandings or disputes when Mobelite’s products or other aspects of our business might seem similar to ideas submitted to us. If you send us your ideas, despite our policy, then regardless of what your letter says, you agree to the following terms:
Your use of the Mobelite, including any information you submit or post to the Mobelite or otherwise provide to us, is governed by Mobelite’s Privacy Policy. Mobelite recognizes that your privacy is very important and takes it seriously Any information you provide to a third party (including by authorizing us to submit content via your Facebook or Twitter account) will be subject to the privacy notice or any similar terms that the third party provides to you, and will not be subject to Mobelite’s Privacy Policy.
To use any downloadable apps developed by us and provided to you directly or on our behalf (“Apps”), including all iOS apps bearing the “Mobelite” logo you must have a mobile device that is compatible with it. We do not warrant that the Apps will be compatible with your mobile device. We hereby grant to you a non-exclusive, non-transferable, revocable license to install and use an object code copy of the Apps for one registered account on one mobile device owned or leased solely by you, for your personal use. You may not: (i) modify, disassemble, decompile or reverse engineer any App, except to the extent that such restriction is expressly prohibited by law; (ii) rent, lease, loan, resell, sublicense, distribute or otherwise transfer any App to any third party or use any App to provide time sharing or similar services for any third party; (iii) make any copies of any App; (iv) remove, circumvent, disable, damage or otherwise interfere with security-related features of any App, features that prevent or restrict use or copying of any content accessible through an App, or features that enforce limitations on use of an App; or (v) delete the copyright and other proprietary rights notices on any App. You acknowledge that we may from time to time issue upgraded versions of an App, and may automatically electronically upgrade the version of an App that you are using on your mobile device, but that we have no obligation to do so. You consent to such automatic upgrading on your mobile device, and agree that the terms and conditions of these Terms of Use will apply to all such upgrades.
The following additional terms and conditions apply with respect to any App that we provide to you that is designed for use on an Apple iOS-powered mobile device (an “iOS App”):
